A minimal degree of creativity

Introduction

We have traversed the implication of creativity (see Figure 6.2). The elucidation of creativity in the preceding chapter opens the way for developing an understanding of a minimal degree of creativity, understood as including creativity. Our understanding of a minimal degree of creativity must be continuous with the understanding established of creativity as human activity directly motivated by considerations of meaning, above a certain level of routinicity. We must now integrate the understanding of creativity obtained with a minimal degree of creativity, in this chapter, in our ascent towards originality (see Figure 7.1).

A minimal degree of creativity, and not just creativity, is required for copyrightability. A minimal degree of creativity includes creativity on an ordinary language reading, but is verbally different as an expression from creativity, by a minimal degree of. Substantive significance for the verbal difference is intimated by creativity also being included in the creative spark ‘so trivial as to be virtually nonexistent’, which does not give rise to copyright. Creativity is then present both in all the copyrightable and in part of the not copyrightable. Careful elucidation of a minimal degree is required to reveal its particular significance.

Different verbal forms in the judgment can be assimilated to a minimal degree of creativity. A review and synthesis of the references to a minimal degree of creativity reveals that it consists of a certain level of creativity and a certain amount at that level. An extremely low level is required. It correlates with the intellectual level classically required for copyrightability. It can be read from the product in question or, failing that, by a further enquiry into the circumstances of construction of the product. The amount needed at the required level is slight. A minimal degree, which combines of level and amount, can be detected from the exchange values connected with the product.

Conditions derivable from the judgment for a minimal degree of creativity -that it must have level, amount at that level, and be knowable - are then all met. Creativity itself is then integrated with the understanding of a minimal degree of creativity obtained. A definitive understanding of a minimal degree of creativity, which incorporates the understanding of creativity obtained, is then established, by the chapter.

Paths for integration

A minimal degree of creativity is elucidated, like creativity, by a close reading of the judgment. All readings, of both semantics and grammar, are ordinary language readings, unless otherwise indicated. Once a minimal degree of creativity has been fully elucidated, it can be reintegrated with creativity, to validate and test the understanding of both a minimal degree of creativity arrived at and that of creativity previously established. The relation of the requirement for a minimal degree of creativity for copyrightability to European and global requirements for copyrightability is also considered.

A minimal degree of creativity

All references to a minimal degree of creativity in the decision can be considered, in sequential order, for their implications.
